We advised a publishing company on a number of HR issues arising as a result of the company’s growth. The company had recently acquired a foreign business which meant a reorganisation of its staff, dealing with more HR issues as its staff had grown and ensuring a smooth transition at a time of great change within the business. This allowed the client to focus on core business, making the acquisition a success.
Staff Handbook for a Growing Company
We acted for a company in the construction industry who were growingly rapidly and needed the correct policies in place to make sure they were compliant with employment legislation. We drafted a bespoke staff handbook that covered all the policies they could need in the future. The client was delighted to have clarity moving forwards with an easy to follow handbook including grievance, disciplinary and a host of other policies. Our form of staff handbook was previously commented on by the Employment Tribunal as being “extremely thorough”.
Racial discrimination and unfair dismissal
Our client was a well known participant in the UK travel industry. An employee brought a claim for unfair dismissal and racial discrimination, having been dismissed for performance-related issues. The individual was determined to obtain a large award at the Employment Tribunal. Through our representations and the evidence we put together, the Employment Tribunal found against the individual on the unfair dismissal and racial discrimination claim, only finding against our client for failing to issue terms of employment within one month of the individual commencing work. Our client was delighted that the compensation award was limited to a nominal amount and that their immaculate reputation remained untarnished.
Sleeping on the job: Gross Misconduct?
We acted for a prestigious prime Central London hotel where an employee was dismissed for sleeping during the working day. The individual would retire to a walk-in cupboard to catch up on some sleep. Unfortunately for him, we were able to produce CCTV of this regular occurrence. His claim for unfair dismissal was rejected by the Employment Tribunal and our client avoided a significant compensation claim.
TUPE transfer: Guiding Our Client Through The Maze
We acted for a global IT company on the successful acquisition of a business that involved the transfer of employees on the basis of a TUPE transfer. A TUPE transfer is where employees enjoy a right to move employer when the business that they work for is sold to a third party. Our client felt that its HR advisor was simply rehearsing the legislation in advice. We provided specific, pragmatic advice that saved our client a great deal of money by advising the client on how to buy the business without incurring the cost of taking on unnecessary staff or making unnecessary compensation payments to those being made redundant. Covid 19: How To Deal With HR Issues In A Pandemic
We advised a hospitality chain on employment and HR issues arising out of the Covid-19 pandemic. The business had been dramatically impacted by lockdown and needed clear, pragmatic advice on how to deal with changes in terms and conditions, redundancies and other issues arising out of the pandemic. The business was able to decide on a restructuring process based on our advice and move forward with certainty and confidence.
Ensuring Compliance and Resolving Headaches
We advised a client in the tech industry on allegations raised by an employee of inappropriate comments made by a line manager in the office. The employee raised a grievance and stopped coming into work on the basis of the stress and anxiety caused by the events. We had drafted our client’s staff handbook and we were able to guide the client through dealing with the grievances, culminating in disciplinary sanctions for the line manager and the employee feeling like they had been heard and that the matter had been dealt with fairly. This avoided a potential employment tribunal claim, which would have been costly for the employer and a loss of management time.
Key Executive Visa Issues Resolved
We acted for a global company on crucial immigration issues relating to one of their key executives.
We advised the client on some very technical issues relating to shareholdings across the global group and guided the client through the process of obtaining visas for the executive and his family. The client was extremely happy as this was a very business sensitive issue. We resolved the issue quickly, provided clear, pragmatic advice and enable the executive to get on with growing the company. Great work!
